Should public school officials have the right to prevent students from wearing pro-American garb on Cinco de Mayo?
This question has been at the heart of a California court battle between the Morgan Hill Unified School District and students who were told by a principal and assistant principal that they could not wear American flag t-shirts on the Mexican holiday back in 2010.
Following the incident, a lawsuit against the district was launched by the students and their families. This week, the case came to a close, with a federal judge ruling against the students — a blow that is likely to infuriate some free speech advocates.
According to U. S. District Court Judge James Ware, the district did not violate the students’ first amendment rights. The judge also found that officials‘ concern over the potential violence that could be incited by the students’ pro-American outfits justified the school’s actions. The Morgan Hill Times has more about the case:
[The parents and students] filed the lawsuit against the school district alleging violations against their First and Fourteenth Amendment rights after their children wore American-themed T-shirts to Live Oak and were sent home after refusing to remove the shirts and apparel after Boden and Rodriguez were concerned about the potential for violence on campus…

Potential violence? Good reason to trample on free speech
This is America,you should have the right to wear the American flag any time you want.
Put in the dress code…NO FLAG SHIRTS, LOGO HATS, PANTS, SKIRTS SHOES WHATSO EVER ALLOWED. NONE SO IT EQUALLY FOOLISH.
The judge got it wrong. If the potential for violence is enough to ban the wearing of the flag, then it also stands to reason that the celebration of a Mexican Holiday in the United States should also be banned. If we were to extend the judges opinion out then maybe the flag should be banned in the entire country during all foriegn holidays ect. HOW ABSURD! This was the perfect opportunity to teach the students that in the you are ALLOWED to express your different opinions and you are expected to accept a persons different views PEACEFULLY!!
Cinco de Mayo is not even a mexican holiday, the gringoes invented it!!!

easy wear American flag shoes. Tatoos, pants. from what the court said was T-Shirts. And I would take the case AS FAR AS POSSIBLE. And document every student that comes to school or any other emblem and NOTHING was done.
And every group that can should drive by the school all day with a American flag on their car.
Time to sell the Socialist Schools.

our kids and protect yours.
Did the school ever think about how much our kids had to give up to
upload these foreigners to our way of life? I think they want our kids
to lower their standards of living just to make illegals feel good, meanwhile it
is business as usual for the illegals, crime, graffitti and anchor babies whilst taking the jobs away from our kids.
Does this judge wipe himself with the American flag? Yet another example that our once great nation is no longer free.

20 years or so. The schools are the churches for the liberals! We should also abolish the Dept. of Education. Let the locals decide what books to buy and what the curriculum should be.

Is the celebration of the Fourth of July recognized in Mexico? Do they forbid the wearing of the Mexican flag on the day because of the possibility of violence? There is an old saying which should be followed ‘When in Rome, do as the Romans do’. For those to dense to understand, it means that you fit in with the ways of the country you are in. We are not in Mexico!!

Although the school should be able to regulate dress code, it should do it fairly for all. The judge is a wimp and caved to the fear of violence. The wuss should step down since he does not have the balls to make decisions based on rights, but fear of terrorism from foreign students. If the school didn’t get money for each student they wouldn’t be as concerned about kicking out the trouble makers.
The school system is pathetic. Tenure keeps bad teachers in and new good teachers from getting jobs. The teachers union is a parasite that sucks on the public for income and gives the teaching profession more than it deserves – supply and demand should dictate their salary and benefits – not a union.
We are also not in Ireland, but we Americans celebrate St. Patrick’s Day. I am a Mexican American and Veteran, so I feel that I should have the right to celebrate any holiday I wish. I agree that the kids should not be forbidden to wear their shirts, if they feel like it, but this country is a melting pot of ethnicity and we should accept the diversity and teach our children that everyone was created equal, just like the constitution states.
There is no such thing as “Mexican American” or African American” or what ever else. You are AMERICAN! Otherwise I’d be considered a Swedish, German, Irish, Indian, Italian AMERICAN…. sounds stupid doesn’t it?
This is the U.S.A. If you are so offended by our flag that you can’t keep from causing violence at a public high school, maybe you should go somewhere you don’t have to look at it anymore. Like back to Mexico.

This is another reason to abolish that court. As Newt Gingrich expalined, Thomas Jefferson abolished over half of the federal Judges, so why can’t we? There are many that just simply aren’t upholding the “Rule Of Law” and need to go.
Some of the people in that school should surround it wearing patriotic clothing and singing” God bless America”.
America….We have the right to display Our Flag anytime and anywhere…If they don’t like it…Shut-Up or Leave…We gave them their Day….We should be able to take it away….They are in Our Country…Show some Grattitude and Respect!!
